RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-03803 COUNSEL: NO HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge be corrected to reflect entitlement to award of the Presidential Unit Citation (PUC). _________________________________________________________________ APPLICANT CONTENDS THAT: His unit presented him with the PUC; however, it was never entered into his service records. The applicant did not provide any documentation in support of his request. The applicant's complete submission is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: On 16 Jun 61, the applicant enlisted into the Regular Air Force. He served 3 years, 7 months and 17 days of total active service. He was credited with one year and two days of Foreign Service. The PUC is awarded to units of the United States Armed Forces for outstanding performance in action against an armed enemy occurring on or after 7 Dec 41, for the United States Army and the United States Air Force units. The unit must have displayed such gallantry, determination, and esprit de corps in accomplishing its mission under extremely difficult and hazardous conditions to have set it apart and above other units participating in the same campaign. The degree of heroism required is the same as that which would be required for award of the Air Force Cross. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID recommends denial. The applicant was assigned to the 11th Civil Engineering Squadron, Altus Air Force Base, Oklahoma, from 26 Nov 61 to 30 Jan 64 and with the 23rd Air Base Group, Da Nang Air Base, Vietnam from 31 Jan 64 to 1 Feb 65. A review of the applicant’s records failed to locate any official documentation awarding the PUC to a unit during the applicant’s period of assignment. To grant relief would be contrary to the eligibility criteria established by DODM 1348- 33, Manual of Military Decorations and Awards, the Secretary of the Air Force, the Chief of Staff, and/or the War Department. DPSID was able to verify the applicant’s entitlement to the National Defense Service Medal (NDSM) and the Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P) for his service from 16 Jun 61 to 2 Feb 65, and were not reflected in his records. Upon final determination by the Board, DPSOR will administratively correct the applicant’s records. The complete DPSID evaluation, with attachment, is at Exhibit C. _________________________________________________________________ APPLICANT’S REVIEW OF THE AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 8 Nov 13, review and comment within 30 days (Exhibit D). As of this date, this office has not received a response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After thoroughly reviewing the evidence of record and noting the applicant’s contention, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
